Dorchester County Disturbing or Unnecessary Noise Ordinance

DORCHESTER COUNTY ORDINANCE NUMBER 90-06

WHEREAS, pursuant to Section 4-9-25, Code of Laws of South Carolina (1976), as amended, the counties of the state were granted authority to enact regulations, resolutions, and ordinances in relation to the health and order in the counties or respecting any subject as appears to them necessary and proper for the security, general welfare, and convenience of the counties or for preserving health, peace, order, and good government in them.

BE IT ORDAINED by the Dorchester County Council, duly assembled, as follows:

1. It shall be unlawful for any person to create or allow to continue any unreasonably loud, disturbing, or unnecessary noise within Dorchester County. Noise of such character, intensity or duration as to be detrimental to the life or health of any individual, or of physical discomfort to a person or ordinary sensibilities, or disturbing of the public peace and welfare is strictly prohibited.

2. As used in this Ordinance, the term "person" shall extend to and be applied to and shall include associations, businesses, clubs, societies, firms, partnerships, and corporations, as well as to individuals.

3. Any person found to be in violation of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a fine not to exceed $200.00, or imprisonment for not more than thirty (30) days.

4. This Ordinance shall be effective upon third reading.
